Terms of service

These terms apply to the use of the VYS Tacho Simulator: the website www.vystacho.nl, the browser simulator and the mobile apps (iOS and Android), including the knowledge base and the tachograph file analysis tool. By using the simulator you agree to these terms.

1. Who we are

The VYS Tacho Simulator is a service of VYS Scheduling BV, based in the Netherlands. Contact: info@vysscheduling.nl.

2. The service

The simulator is an online training environment that reproduces the operation of digital tachographs, including the VDO DTCO 4.1 and the Stoneridge SE5000 Smart 2. It is intended for practising and explaining tachograph operation and the related rules.

3. Training tool, not an official instrument

  • The simulator is an independent training tool and is not affiliated with or endorsed by Stoneridge, Aumovio/VDO (Continental) or any authority. Brand names mentioned are the property of their respective owners.
  • The simulation may differ from a real unit or from current legislation on specific points. No rights can be derived from the simulator or the knowledge base; the real unit, the manufacturer manual and applicable law always prevail.
  • The analysis tool provides an indicative analysis and is not an official enforcement or inspection instrument.

4. Access

  • Access is bought in the app as a one-off 24-hour or 1-week pass. This is not a subscription and does not renew automatically.
  • Access codes issued through a training provider or employer are personal and non-transferable.
  • We may block access in case of abuse, such as sharing codes, automated use or attempts to copy the service.

5. Payment and withdrawal

  • Payment is handled entirely by the App Store (Apple) or Google Play, at the price shown there.
  • Access is digital content delivered immediately after purchase. By purchasing you consent to immediate delivery and waive the right of withdrawal for this digital content.
  • Refund requests are handled through Apple or Google respectively.

6. Use

  • You use the service only for its intended purpose: practising and learning.
  • You may not copy, decompile, reverse engineer or resell the software, or retrieve content by automated means (scraping).

7. Availability

We aim to keep the service available but do not guarantee uninterrupted availability. Maintenance, outages or changes to the service may temporarily limit availability.

8. Intellectual property

All rights to the simulator, the website, the knowledge base and the imagery rest with VYS Scheduling BV or its licensors.

9. Liability

  • The simulator is a training environment. VYS Scheduling BV is not liable for damage, fines or sanctions arising from actions performed on a real tachograph or from interpretation of the information provided.
  • Beyond that, the liability of VYS Scheduling BV is limited to the amount you paid for access.
  • Nothing in these terms limits liability that cannot be limited under mandatory law.

10. Privacy

How we handle personal data is described in the privacy policy.

11. Changes

We may change these terms. The current version is always available at www.vystacho.nl/en/terms, with the date of the last change at the top. We announce substantial changes on the website or in the app.

12. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
