The driving and rest times (EU Regulation 561/2006) apply across Europe, but the fine amounts differ widely per country. Some countries use fixed amounts, others use bands, classes or a formula per percent of excess. The table below shows the official fine amount per offence in the national currency.

A dash (–) means there is no fixed fine for that offence in that country. The fine is then set case by case at the time of the offence, by the enforcement officer or the national system, depending on the severity.

A "≤" in front of an amount means the law of that country only sets an upper limit and no amount per offence. How high the fine goes within that limit is decided case by case by the enforcing authority. This applies to Czechia: Act 111/1994 Sb. gives the driver a maximum, not a tariff.

Fine amounts are taken directly from the official national fine catalogues and legislation. No estimate is shown for infringements without a published national amount. The final amount may differ per case, for instance in the event of repetition or intent.

ERRU points: what an infringement costs the transport company

On top of the roadside fine, every driving and rest time infringement counts in ERRU, the European Register of Road Transport Undertakings. Those points are not recorded against the driver but against the transport undertaking. They decide which risk band the company falls into, and with that how often and how strictly it is inspected.

The four seriousness levels and their weight

1MI

Minor infringement

Daily driving time of 9 hours exceeded up to under 10 hours (where an extension is not allowed), or 4.5 hours of uninterrupted driving exceeded up to under 5 hours.

10SI

Serious infringement

5 to 6 hours of uninterrupted driving without a break, or daily driving time of 10 to 11 hours where an extension to 10 hours is not allowed.

30VSI

Very serious infringement

6 hours or more of uninterrupted driving, daily driving time of 11 hours or more where an extension to 10 hours is not allowed, or no manual entry made where it was required.

90MSI

Most serious infringement

Daily driving time exceeded by 50% or more without a break or rest of 4.5 hours, or driving with a falsified card or someone else's card. The latter counts as driving without a driver card.

The classification comes from Annex III of Regulation (EU) 2016/403, the weight per level from Implementing Regulation (EU) 2022/695.

From points to a risk band

For each check the points are weighted by the number of vehicles checked and averaged over all checks, including checks without an infringement, which count as zero. Infringements count for two years. The result falls into one of four colours:

Grey
No check carried out yet
Green
0 to 100 points: low risk
Amber
101 to 200 points: medium risk
Red
201 points or more: high risk

When the licence is at stake

The risk band itself does not cost a licence, but repeated infringements affect the good repute of the undertaking and the transport manager. At European level, per driver per year: three serious infringements count as one very serious infringement, and three very serious infringements start a national procedure on good repute. That procedure can end in suspension or withdrawal of the licence. Member States may set stricter thresholds.

What are ERRU points?

ERRU is the European Register of Road Transport Undertakings. Every infringement gets a weight by seriousness: minor 1, serious 10, very serious 30 and most serious 90. The weighted average over two years decides the transport undertaking's risk band: green, amber or red.

Does the driver get ERRU points himself?

No. The risk band belongs to the transport undertaking. The frequency per driver per year does count towards the company's good repute: three serious infringements per driver count as one very serious infringement.

Can a company lose its licence because of ERRU points?

Not through the risk band itself, which decides how often and how strictly it is inspected. Three very serious infringements per driver per year do start a national procedure on good repute, which can end in suspension or withdrawal of the licence.

Are these fine amounts exact?

The amounts are taken directly from the official national penalty catalogues and legislation. The actual fine depends on the extent of the offence, repeat offences and the judgement of the enforcer.

Why do fines differ per country?

The driving and rest times themselves are the same across the EU (Regulation 561/2006), but each country sets its own fine amounts and system.
